The Property Department encompasses our main area of practice which is headed by Mr. KF Wong and Mr. Alex SS Lee jointly. This Department oversees the banking and financing aspects to the Property Department’s requirements and is ably assisted by our member of staffs.
Our firm continues to represent developers, institutional lenders such as banking and financial institutions, building society, individual Malaysian and non-Malaysian investors on all property matters with emphasis on commercial understanding and flexibility. We have continuously given advice and opinion to foreign individuals and companies for property related transactions in Malaysia including the Malaysian Government’s Foreign Investment Committee’s requirements and criteria in order that our clients may recognise the intrinsic value of real estate in Malaysia and the pertinence of foreign investment to property and development sector of the Malaysia economy.
Our Property Department undertakes property related instructions on a daily basis and these activities include work on property ownership, sale, purchase, construction, renovation, financing & development, planning, environmental, conversion, subdivision, partition, surrender, amalgamation & issuance of titles and valuation liaison; also operation of residential, commercial, agriculture and industrial properties in a wide range of development projects throughout the country. A broader practice undertaken by this Department has been lease, tenancies, easements, grant of right of way for major Projects and retail spaces for commercial ventures.

On all these property and development related matters, observation and compliance with property and land law in Malaysia has been an ongoing responsibility with land use and regulatory issues being undertaken by our Property Department including property and land related litigation.
Messrs. KF WONG & LEE’s Banking & Finance Department advises banking and financial institutions and corporate entities on their financing requirements. This Department consists essentially of the Consumer and Retail Finance Team and the Corporate Banking Team. Our personnel within this Department haves comprehensive banking and finance related experience having advised on wide variety and disparate financial transactions varying from single bank dealings to commercial or trade line finance facilities and is capable of structuring strategic arrangements including the documentation of the resultant financial transactions.
Our Consumer and Retail Finance Team has established a long-term support with our top banking clients and is well versed in this area attending to retail as well as individual clients for property, housing and consumer credit facilities. Increasingly we have been involved in dealing with Islamic Finance documentation.
Ever since the onset of Islamic Banking practices, our firm has been instructed and entrusted to handle security documentation for Islamic Banking Facilities for all types of property including property with the issuance of individual/separate title(s) and also property where
individual/Strata Title(s) have yet to be issued and is/are still being held under master title(s). Besides the security documentation under the concept of Al-Bai Bithaman Ajil that we have the requisite experience; our Firm have also been exposed to the opening and operation of Saving Accounts under the concept of Al-Wadiah and the Fixed Deposit Account under the concept of Al-Mudharabah in connection to the customer(s) security documentations and monthly installment repayments.
Our Corporate Banking Team has serviced and is knowledgeable in the creation of loans and other credit facilities in numerable scenarios. We have provided legal advice and service to bridging finance, project financing, commercial loans, trade line finance facilities amongst others.
On the general commercial front our Banking and Finance Department actively undertakes work on securitization lending for commercial trade and other debt transaction in addition to advice on rescheduling and restructuring of banking and financial facilities.
Our Corporate and Commercial Department is established as a result of legal experience and working knowledge of our Mr. KF Wong and Mr. Alex SS Lee; and this is a progressively advancing practice due to the relative broad range and connectivity with other practice areas in law.
In implementing a comprehensive corporate commercial strategy for our clients we have been faced with the responsibility of raising and implementing accurate and commercially viable financing packages which has involved amongst others the restructuring of borrower companies in order to be able to secure such financing.
Due to the extensive work undertaken by the Banking and Finance Department, we have been always involved with rescuing and salvage exercises to protect the interest of the lenders and increasingly have even undertaken the responsibility of saving the financial viability and going concern of borrowers to create feasible
working solutions. Through our collaboration with the expert corporate recovery and insolvency practitioners such as qualified liquidators; we have been able to provide a comprehensive set of service to our clients.
We have been involved in numerous insolvency exercises. Some of these have concerns of multi million ringgit involving companies undergoing voluntary winding-up or court winding-up; and we are privileged and honoured to be considered as a member of the Panel of Solicitors acting for liquidators and/or receiver(s) & manager(s) concerning corporate entities such as Zanshin Plastic Industrial Sdn. Bhd, OKC Development (M) Sdn. Bhd. and Sineo Enterprise Berhad (Skudai Parade Mall).
Besides the corporate recovery exercise; our Mr. KF Wong has been actively involved in the corporate insolvency exercises in advising lenders, assisting liquidators and receivers & managers apart from acting for clients and had been successful in the petition for the winding-up of respondent companies.
In our regular service to our clients we encounter the need to cater for their contractual requirements where we are constantly instructed to draft and conclude their contractual requirements on a broad range of issues and accordingly have complied to fulfill their instructions professionally. Of late we have also undertaken numerous contractual works related to the Mining sector in Malaysia and beyond. Our personnel are knowledgeable and well versed with the Mining sector and laws in Malaysia having conducted legal service and advice on mining agreement, joint operations, contractual work operations amongst others. As a result of this growing practice, our personnel are also active with clients going overseas from Malaysia and we have been involved with providing advisory service to such clients where they embark on mining business in Indonesia and Papua New Guinea.
Additionally, we are also engaged by Multi National Companies in the provision of advice and drafting of legal documents and instruments related to Franchising and Licensing of products. We have also been engaged for cross border work on this matter to protect the intellectual proprietary rights of these clients in regions as diverse as Indonesia, Singapore, Thailand and Vietnam.
Our Corporate Joint-Venture Department is actively instructed by clients on various aspects of corporate advisory projects including advising corporate entities on their joint venture endeavors.
Our Mr. K F Wong and Mr. Alex SS Lee have comprehensive experience in advising parties to a joint venture in several projects in relation to Property Development schemes and Timber Logging in Malaysia and within these sphere of Joint Venture advisory practice we are assisted by Mr. Mohan Narayan.
In total our Corporate Joint-Venture Section has been extensively involved in a number of exercises such as the formulation, conception and sealing of joint venture projects between corporate entities and joint venture between local state government, quasi government bodies and private companies.
The Partnership & Agency Department of KF Wong & Lee has ample experience and exposure in the formulation, formation, withdrawal and additional of partners, registration and dissolution of partnerships.
In advising our clients as to the registration of firm/partnership requirement and the dissolution procedures; we have also been actively involved in the drafting of major partnership deed and the Deed of Dissolution of Partnership apart from advising our clients in all related matters such as pre and post dissolution liabilities and the management or the operation of partnership bank account.
Messrs. KF Wong & Lee’s Equity & Trusts Department advises both corporations and individuals on matters concerning equity law and trust matters in the Malaysian context as well as in the context of foreign jurisdiction such as in the England and Hong Kong.
Our Mr. KF Wong has been invited to deliver talks and participate in Seminars especially in Mandarin concerning the topics of Wills and Distribution of Estates by insurance company such as Aetna Insurance Sdn. Bhd. and many other Associations and Societies.
We have been actively representing clients in the Petition for Probate and Letters of Administration in court as well as applying for clients in the small estate distributions at the Land Office(s).
In order to supplement and to provide a complete set of advise to corporate entities in their endeavors; we have set up the Company Secretarial Practice Department in giving services of advice and the registration or incorporation of limited companies.
Our Mr. KF Wong has the requisite experience in advising and registering limited companies for local clients as well as foreign interests such as corporate entities from Tianjin in China, Hong Kong SAR and Taiwan.
Our Mr. Alex SS Lee and Mr. Mohan Narayan have been involved in incorporating companies and corporations in the Republic of Indonesia and progressing to protect the shareholders and office of these companies.
The Intellectual Property Department of Messrs. KF Wong & Lee has been actively involved in matters of trademarks, industrial designs and copyrights and this section is led by Mr. KF Wong himself and he is presently assisted by Mr. BC Choo.
This Department concerns the works of advising in the preparatory stage, registration requirements, gazetting and protecting trademarks related to goods and services within the laws of trade marks in Malaysia.
Also, our Mr. KF Wong has been involved in advising clients in matters of copyrights, industrial designs and methods of protecting the same. Among our clients are Taiwanese and Chinese companies incorporated locally in the manufacturing of sports equipments and companies in the sound recordings industry.
Our firm’s Bankruptcy Department is actively instructed by clients on matters pertaining to the legal requirements in the commencement of proceedings and defending cases of bankruptcy as well as discharging the same.
Our Mr. Alex SS Lee who is ably assisted by Mr. Azmi have been handling matters involving cases of petitioning for corporate clients against individual judgement debtors as well as defending individuals.
As our firm is in the panel of a number of financial institutions, we are privileged to have been entrusted with being instructed to act on Foreclosure Proceedings both in the High Court and Land office inquiry under the National Land Code 1965 as well as seek auction sales and attend to such sales for properties involving master titles where separate individual titles/strata titles are yet to be issued/transferred.
Motor Vehicles Claims Department is dealing with the entire spectrum and types of claims involving motor vehicles accidents and this Department is presently led by our Mr. Alex SS Lee and assisted by Mr. Lim Yew Leong.

Besides the above we are also involved in the suing and defending of clients’ matters concerning personal injuries and fatal accidents consequential from road accidents.
Arbitration and Mediation Department is a new Department in our firm headed by our Mr. KF Wong and he is currently assisted by Mr. BC Choo on matters arising.
Most Contractual Agreement especially construction agreement contain Arbitration clause which precludes the potential litigation in court of laws and at the same time promotes expert/technical and with speedy solution by way of arbitration. In other cases, mediation is another mode of resolution without the need of litigation.
Our Mr. KF Wong has the experience of acting as Advocate/Counsel in arbitration matters and as a mediator in dispute between clients.
